What should you do when the police stop you for a traffic offence? Here are the essentials you should know:
Remain calm and cooperative
Stay polite and avoid arguing with the police officer.
Show the officer your driving licence and other required documents such as the certificate of insurance and vehicle inspection certificate when required.
Understand the allegation
Ask the officer to explain the specific traffic offence you are accused of committing.
A list of minor traffic offences and their penalties are listed here.
Do not offer a bribe
Offering or accepting a bribe is a criminal offence under the Anti-Corruption and Economic Crimes Act, and it will get you into further trouble. Always handle the matter through legal channels.
Understand the process
If the offence is minor, the police should not detain you. You should first be granted the opportunity to pay a fine or bail. The bail amount should not exceed the penalty for the offence.
You will be issued with a police notice to attend court on a specific date within seven days. The notice should indicate the offence you are charged with and the maximum penalty.
The notice gives an option of admitting to the charges in writing.
You must attend court as directed on the notice, otherwise a warrant of arrest will be issued, and your bail will be forfeited. In court, the charge will be read out and you can plead guilty or not guilty.
If you plead guilty you will receive a fine.
Processing of traffic fines is done in open court.
If you cannot pay the fine, you will be placed in prison custody until you can pay.
If you plead “not guilty” you will go through a trial process like any other criminal charge.
Request a receipt for any payment
If paying bail or a fine, ensure that you get an official receipt to ensure that payment is properly documented and traceable.
